PART-TIME EMPLOYEE AGREEMENT & NON-DISCLOSURE AGREEMENT (NDA)
This Agreement (the “Agreement”) is made and entered into as of the date of signing by and between Hidden Bee Learning (“Employer”) and [Employee Name] (“Employee”). The purpose of this Agreement is to outline the terms and conditions of part-time employment as well as to protect confidential and proprietary information disclosed during employment.
1. POSITION AND DUTIES
- 1 Position: Employee is hired as a [Teacher/Teacher Assistant].
- 2 Duties: Employee shall perform the following duties based on their position:
- Teacher: Responsible for planning and leading classroom activities, delivering instruction, assessing student progress, and maintaining classroom management.
- Teacher Assistant: Supports the lead teacher in classroom activities, assists students, prepares materials, and supervises students as needed.
- 3 Location: Employee shall primarily work at [Work Location] unless otherwise directed by Employer.
2. COMPENSATION
2. 1 Agreed Upon Compensation: The employee’s compensation will be determined individually and documented in a separate written agreement. The agreed-upon rate will be provided in writing, signed by both parties, and returned to the employee for their records.
2. 2 Payroll Schedule: Employee shall be paid bi-weekly in arrears.
2. 3 Overtime: Any overtime must be pre-approved in writing by management and will be compensated in accordance with state and federal law.
3. WORK SCHEDULE
3. 1 Hours: Employee is scheduled to work from 9:00 AM to 12:00 / 1:00 PM, [Days of the Week]. – will be determined individually
3. 2 Breaks: Tennessee labor laws do not require breaks for shifts under six hours; therefore, no formal breaks are provided during this period.
3. 3 Attendance: Employee must adhere to the attendance policy, including providing notice for absences.
4. BENEFITS AND LEAVE
4. 1 Paid Time Off (PTO): Part-time employees are not eligible for PTO.
4. 2 Holidays: Hidden Bee Learning observes the following holidays: [List of Holidays]. If a scheduled workday falls on a holiday, the employee will not be required to work and will not receive compensation for that day.
4. 3 Sick Leave: There are no paid sick days for this position. If you are unable to attend work due to illness, please notify your supervisor as soon as possible.
5. CONFIDENTIALITY AND NON-DISCLOSURE
5. 1 Confidential Information: “Confidential Information” means any proprietary, sensitive, or non-public information relating to Hidden Bee Learning, including but not limited to:
- Student records and personal information
- Curriculum plans and teaching methods
- Financial data and business strategies
- Employee and staff details
- Any other information designated as confidential
5. 2 Exclusions: Confidential Information does not include information that is:
- Publicly available without breach of this Agreement
- Independently developed by the Employee without reliance on Employer’s information
- Rightfully obtained from a third party without breach of confidentiality
5. 3 Obligations of Employee: Employee agrees to:
- Maintain the confidentiality of all Confidential Information
- Use Confidential Information solely for the purpose of fulfilling job duties
- Not disclose, distribute, or share Confidential Information with unauthorized persons
- Take reasonable measures to protect Confidential Information from unauthorized access
5. 4 Permitted Disclosures: Employee may disclose Confidential Information if required by law, provided they give prior written notice to Employer.
5. 5 Return of Materials: Upon termination of employment, Employee must:
- Return all documents, materials, and electronic files containing Confidential Information
- Not retain any copies, notes, or summaries of Confidential Information
6. TERM AND TERMINATION
6. 1 At-Will Employment: Employment is at-will and may be terminated by either party at any time, with or without cause, in accordance with state laws.
6. 2 Notice Period: Employee agrees to provide [Number] weeks’ notice before resigning.
6. 3 Return of Company Property: Upon termination, Employee must return all company property, including documents, keys, and electronic devices.
6. 4 Duration of NDA: This Agreement remains in effect throughout the Employee’s tenure and for a period of [Number] years after termination of employment.
6. 5 Consequences of Breach: Unauthorized disclosure of Confidential Information will result in disciplinary action, including possible termination and legal recourse.
7. GENERAL PROVISIONS
7. 1 No Employment Rights Beyond This Agreement: This Agreement does not create an obligation for continued employment.
7. 2 Governing Law: This Agreement shall be governed by the laws of the State of Tennessee.
7. 3 Severability: If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect.
8. ACKNOWLEDGMENT AND SIGNATURES
By signing, both parties acknowledge that they have read, understand, and agree to the terms of this Agreement.
